Welcome to Attention Insight, a platform that offers tools to predict human responses to images and videos. These Terms of Use (“Terms”) govern your use of our services, software, websites, and applications (collectively referred to as “Services”).

Acceptance of Terms

Please read these Terms carefully before using our Services. By using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services.

Description of Services

Attention Insight provides various services, including the following:

Attention Insight Predictive Eyetracking: This service predicts what will draw attention in images and videos.
The Attention Insight Platform: This service allows you to store, organize, share, and receive content from multiple sources.
Additional features and functionalities.

You understand and agree that our Services may be provided online, as mobile and/or desktop applications, or integrated into third-party services.

Price:

All users get a free trial for 7 days and get 7 credits. If users need more credits, they could subscribe and buy additional credits per month.

1 credit is charged for:

1 image or URL analysed (up to 3 viewports). Additional charge for longer images: +1 credit for each additional 3 viewports;
1 separate viewport analysis in a long image (when you select the viewport area and click ‘Analyse’);
1 AI recommendation request;
1 sec. of video analysed;
4 API transactions.

Using add-ons (plugins) will consume credits the same as in Web app.

User Content

The Services enable you to upload, submit, store, share, receive, collect, capture, and visualize your ideas, texts, graphics, videos, data, information, files, presentation decks, or other content (“User Content”). You retain all ownership rights to your User Content, and we do not claim any ownership of it.

Ownership and Responsibility

The Services are provided by Attention Insight, owned by UAB Attention Insight, with its main office located at Kareivių g. 19-78, LT-09133 Vilnius, Lithuania, registered at Lithuania’s State Enterprise Centre of Registers under number 304999911.

Applicability and Third-Party Services

These Terms apply to all users of the Services who are 16 years of age or older. When using the Services, you also agree to comply with any additional terms of use, notice and takedown policies, and privacy and cookie policies of any third-party services that may be integrated with our Services. If you use the Services on behalf of your employer or another organization, you represent and warrant that you have the authority to do so, and you agree to the terms of that organization.

Amendments to the Terms

We may amend these Terms from time to time. Any amendments will become effective upon being posted on our website(s) and/or mobile and/or desktop application(s), or at a later date indicated in the amended Terms. It is recommended that you review the Terms periodically. Your continued use of the Services after any amendments constitutes your acceptance of the updated Terms. In the case of material changes, we will provide prior notice through various means.

User Obligations and Restrictions

When using the Services, you agree to:

Comply with applicable laws and these Terms.
Respect the rights of others, including intellectual property rights.
Not engage in unlawful, harmful, or offensive activities.
Not use the Services to distribute, promote, or facilitate prohibited content.
Not abuse, harass, threaten, or intimidate others.
Keep your account information and password confidential.
Not interfere with the Services’ security or functionality.
Not access non-public areas of the Services or use unauthorized methods to collect user information.
Not send viruses, spam, or engage in any malicious activities.
Not reverse engineer, resell, sublicense, or commercialize the Services without our permission.
Not allow others to use your account.

Intellectual Property Rights

Attention Insight retains all intellectual property rights to the Services, including software, content, trademarks, logos, and patents. You may not use, modify, copy, distribute, or reverse engineer any part of the Services without our permission. We are not responsible for third-party content published within the Services.

User License and Content Usage

By using the Services, you grant us a license to use, host, store, scan, search, sort, index, create previews, reproduce, communicate, publish, publicly display, distribute, and edit your User Content for the sole purpose of operating, enabling, and improving the Services. This license does not apply to content shared via Attention Insight File Sharing. We do not sell or advertise your User Content. For more information, please refer to our Privacy policy.

Limitation of Liability and Disclaimer

Attention Insight provides the Services “AS-IS” and does not provide any warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not responsible for any damages, loss of data, or unauthorized access to your account. Our liability is limited to the extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless UAB Attention Insight and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in connection with your use of the Service, violation of these Terms, or infringement of any intellectual property or other rights of any third party.

Termination

You may cancel your subscription at any time. Upon cancellation or non-payment, your account may be deactivated, and your User Content and personal data may be permanently deleted from our servers.

Governing Law and Jurisdiction

These Terms are governed by Lithuanian law. Any disputes will be subject to the exclusive jurisdiction of the competent court in Lithuania.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and UAB Attention Insight regarding the Service and supersede any prior or contemporaneous agreements, communications, or understandings, whether oral or written.

Changes to Terms

We reserve the right to modify or update these Terms at any time, effective upon posting the revised Terms on the Service. Your continued use of the Service after any such changes shall constitute your consent to the modified Terms.
